PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE DIGITAL SERVICES.
These terms of service (“Terms”) set out how you may use the Golf Traveller Website, the Golf Traveller mobile application, and associated digital services (each a “Digital Service”, and collectively the “Digital Services”).
The Digital Services are operated by Sports Travel Group Limited, a company registered in England and Wales (company number 09172243), with a registered office at 642 Kings Road, London, SW6 2DU ("we", "us", or "our"). You may contact us about the Digital Services at info@golftraveller.com.
1. ACCEPTANCE
1.1 Your access to, and use of the Digital Services constitutes acceptance of these Terms and forms a legally binding agreement between you and us.
1.2 These Terms apply to all users, including visitors, registered account holders, and customers.
1.3 If you are using the Digital Services on behalf of a business, you confirm that you have authority to bind that entity to these Terms.
1.4 If you do not agree to these Terms, you must cease using the Digital Services immediately.
2. OTHER TERMS THAT MAY BE APPLICABLE TO YOU:
2.1 Our Privacy Policy – This policy outlines how we will process any personal data in compliance with applicable laws.
2.2 Our Travel Bookings Terms and Conditions – These terms govern any physical travel services, itineraries, or trips purchased through Golf Traveller, and will be provided at the point of sale.
3. YOUR ACCESS TO AND USE OF THE DIGITAL SERVICES
3.1 You may use the Digital Services for your personal, non-commercial purposes including:
3.1.1 Discovery and Research: browsing, searching, and viewing information regarding trips, events, and services, as well as our company ethos and values.
3.1.2 Booking and Financial Management: accessing, downloading, and managing your (or another travellers) bookings, digital itineraries, content, invoices, and payment records, as well as updating your personal preferences, and account profile. Where you act on behalf of another traveller, you confirm that you have the explicit permission of that traveller (or their parent/legal guardian if they are under the age of 18) to do so.
3.1.3 Coordination and Communication: sharing proposals or itineraries with your specific travel group for coordination purposes, and contacting us with enquiries, support requests, or feedback.
3.2 You must not use the Digital Services:
3.2.1 In any way that breaches any applicable local, national or international law or regulation;
3.2.2. In any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect;
3.2.3. To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware; or
3.2.4 To collect or harvest any information or data from the Digital Services or attempt to decipher any transmissions to or from the servers hosting the Digital Services.
3.3 You also agree:
3.3.1 Not to reproduce, duplicate, copy or re-sell any part of the Digital Services;
3.3.2. Not to access without authority, interfere with, damage or disrupt any part of the Digital Services, any equipment or network on which the Digital Services are stored, any software used in the provision of the Digital Services, or any equipment or network or software owned or used by any third party; and
3.3.3 Not to conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to the Digital Services.
3.4 We reserve the right to suspend or terminate access to any Digital Service at our sole discretion, without prior notice.
4. UPDATES TO THE DIGITAL SERVICES
4.1 From time to time, we may automatically update the Digital Services to improve performance, enhance functionality, reflect changes to the operating system, or address security issues.
4.2 Alternatively, where the Digital Service is stored on your device, we may ask you to update the Digital Service for these reasons. If you choose not to install such updates or if you opt out of automatic updates you may not be able to continue using the Digital Services.
5. USER ACCOUNTS
5.1 In order to access certain elements of the Digital Services, such as the Golf Traveller mobile application and personalized digital itineraries, you may be required to register for an account.
5.2 When you register for an account, you agree to abide by the following terms:
5.2.1 Eligibility: You must be at least 13 years of age to register for an account for the Digital Services. If you are between 13 and 18, you must have your parent or legal guardian’s permission to register for an account. By creating an account, you represent that you have obtained this consent.
5.2.2 Parental Responsibility: If you are a parent or guardian permitting your child (between 13 and 18) to register and use an account on the Digital Services, you agree to be bound by these Terms on their behalf, and are fully responsible for their activity, including the data they provide, and their compliance with these Terms.
5.2.3 Accuracy: You agree to provide accurate, current, and complete information during the registration process, and to maintain the accuracy throughout the duration of your account.
5.2.4 Security: You are responsible for safeguarding the password and device that you use to access the Digital Services. You agree not to disclose your login credentials to any third party and to notify us immediately of any unauthorized use of your account.
5.3 We reserve the right to suspend or terminate your account and at our sole discretion, without prior notice, including for conduct that we believe violates these Terms or is harmful to other users, our business, or third parties.
6. INTELLECTUAL PROPERTY
6.1 All intellectual property rights in the Digital Services, including, but not limited to, the storyboards, itinerary layouts, and images, throughout the world, belong to us (and our licensors) and the rights in the Digital Services are licensed (not sold) to you.
6.2 You have no intellectual property rights in, or to, the Digital Services, other than the right to use them in accordance with these Terms.
6.3 Where you upload, submit, or otherwise make available any content through the Digital Services, you grant us a worldwide, royalty-free, non-exclusive, sublicensable and transferrable licence to use, host, store, reproduce, modify, adapt, publish, translate, distribute and display that content in connection with the operation, promotion and improvement of the Digital Services for the duration of your use of the Digital Services, and for a reasonable period thereafter.
6.4 You confirm that you own or have the necessary rights, licences, consents, and permissions to grant us the licence outlined in the preceding paragraph, and that this content will not infringe the intellectual property rights, privacy rights, or any other rights, of a third party.
7. BREACH OF THESE TERMS
7.1 When we consider that a breach of these Terms has occurred, we may take such action as we deem appropriate.
7.2 Failure to comply with these Terms may result in our taking all or any of the following actions: 7.2.1. Immediate, temporary or permanent withdrawal of your right to use the Digital Services;
7.2.2 Immediate, temporary or permanent removal of any account you have to access the Digital Services;
7.2.3 Issue of a warning to you; and/or
7.2.4 Disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.
8. LIABILITY
8.1 While we strive to provide a seamless digital luxury experience, we do not guarantee that the Digital Services or any content therein will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of the Digital Services for any reason without notice.
8.2 The Digital Services are provided on an "as is" or "as available" basis. The Digital Services, and the content therein (including, but not limited to any travel update related push notifications, or messaging) is not intended to amount to advice on which you should rely. We do not control, and are not responsible for, the availability or accuracy of any third-party services, data, or content contained within the Digital Services. We make no representation or warranties of any kind whether express or implied as to the operation of the Digital Services or the information, content or materials included therein.
8.3 To the fullest extent permitted by applicable law, Sports Travel Group accepts no liability for any direct, indirect, or consequential loss or damage arising from your use of, or inability to use, our Digital Services. While we use reasonable endeavours to ensure information is accurate, we make no warranties that the data provided on the Digital Services is perfectly complete or up to date.
9. CHANGES TO THESE TERMS
9.1 We reserve the right to modify these Terms at any time.
9.2 We will provide notice of significant changes by updating the document within the relevant Digital Service.
9.3 Your continued use of the Digital Service following such updates constitutes your acceptance of the revised terms.
10. GOVERNING LAW AND JURISDICTION
10.1 These Terms and any dispute or claim arising out of or in connection with these Terms, or the Digital Services, shall be governed by and construed in accordance with English law.
10.2 By agreeing to these Terms, you acknowledge and agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
